At the recent Annual General Meeting held on 22 April 2009, there were amendments/ additions to the By-Laws. We have updated the By-Laws and circulate this revised booklet (comprising the updated By-Laws) for your easy reference.
Pleased be advised that By-Laws are governed under section 32 of the Building Maintenance And Strata Management Act (Cap 30C) {BMSMA}. The Management Corporation, subsidiary proprietors and any mortgagee in possession (whether by himself or any other person), lessee or occupier of a lot are all bound by the approved By-Laws of the Management Corporation as well as the prescribed By-Laws of BMSMA.
In breach of any By-Law, section 32(10) of the BMSMA provides that the Management Corporation, subsidiary proprietor, mortgagee in possession, lessee or occupier of a lot shall be entitled to apply to the court:-
a) for an order to enforce the performance of or restraint the breach of any-by-law; or b) to recover damages for any loss or injury to person or property arising out of the breach of any by-law from,
any person bound to comply therewith, the Management Corporation or the Managing Agent.
Also approved at the last Annual General Meeting, it must be highlighted that a subsidiary proprietor or occupier of a lot shall bear all costs and expenses incurred by the Management Corporation (including all legal costs and disbursements on a full indemnity basis) in any action commenced or undertaken in the Singapore Courts or referrals made to the Strata Title Board by the Management Corporation in respect of the infringement(s) by the subsidiary proprietor or occupier of the by-laws of the Management Corporation {including but not limited to the by- laws set out in the Land Titles (Strata) Act (Cap. 158) and The Building Maintenance And Strata Management Act (Cap 30C)}.
